Welcome to SimCare AI, operated by Soma Lab, Inc. (“SimCare,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our AI-powered simulation platform, field-experience management tools, website, and related services (collectively, the “Services”).
BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT USE THE SERVICES.
1. WHO IS THIS FOR? (ENTERPRISE USERS)
Most users access SimCare through a university, college, or training program (“Institution”) that has entered into a separate agreement with us (the “Enterprise Agreement”).
If you are a Student or Faculty Member: Your use of the Services is subject to the Enterprise Agreement between SimCare and your Institution. If there is a conflict between these Terms and the Enterprise Agreement, the Enterprise Agreement controls.
Your Account Status: Your access is granted and managed by your Institution. If you leave the Institution, or if the Institution stops paying for the Services, your access will be terminated.
2. ACCOUNT REGISTRATION
2.1 Information. You agree to provide accurate, current, and complete information during the registration process.
2.2 Credentials. You are responsible for safeguarding your password. You agree not to disclose your password to any third party. You are responsible for any activity that occurs under your account.
2.3 Age Requirement. You must be at least 18 years old to use the Services.
3. ACCEPTABLE USE POLICY
You agree not to do any of the following while using the Services:
3.1 No Abuse or Harm.
Harass, threaten, or defraud other users or SimCare staff.
Input content that is hate speech, sexually explicit, gratuitously violent, or promotes illegal acts.
3.2 No Technical Attacks.
Attempt to reverse engineer, decompile, or extract source code or the weights/parameters of our AI models.
Use any automated system (robots, spiders, scrapers) to access the Services.
Attempt to "jailbreak" or manipulate the AI to ignore its safety guardrails or generate prohibited content.
3.3 No False Representation.
Impersonate any person or entity.
Misrepresent your affiliation with an Institution.
4. AI & MEDICAL DISCLAIMERS (CRITICAL)
4.1 Simulation Only. The Services are an educational simulation tool. The AI "patients" are fictitious characters generated by software. They are not real people, and their responses do not constitute medical, psychological, or clinical advice.
4.2 No Clinical Reliance. The content provided by the AI is for training purposes only. It may contain errors, inaccuracies, or hallucinations (false information presented as fact). Always rely on your professional training, supervision, and standard clinical protocols when treating real patients.
4.3 No PHI (Protected Health Information). You agree NEVER to input real patient names, dates of birth, medical records, or any other Protected Health Information (PHI) into the Services. If you do so, you violate these Terms and potentially federal law (HIPAA).
5. INTELLECTUAL PROPERTY
5.1 SimCare Rights. SimCare and its licensors exclusively own all right, title, and interest in and to the Services, including all software, AI models, case scenarios, logos, and trademarks.
5.2 Your Content. As between you and SimCare, you (or your Institution, pursuant to its policies) retain ownership of the inputs and assignments you submit to the Services. You grant us a license to use this content solely to provide the Services to you and your Institution.
6. TERMINATION
We may suspend or terminate your access to the Services immediately, without prior notice or liability, if:
You breach these Terms (specifically the Acceptable Use Policy).
Your Institution instructs us to terminate your access.
Your Institution’s subscription expires or is terminated.
7. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMCARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. LIMITATION OF LIABILITY
SIMCARE’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DIRECTLY TO SIMCARE (IF ANY) IN THE PAST 12 MONTHS; OR (B) ONE HUNDRED U.S. DOLLARS ($100).
9. GENERAL PROVISIONS
9.1 Governing Law. These Terms are governed by the laws of the State of Delaware.
9.2 Severability. If any provision of these Terms is held to be invalid, the remaining provisions shall remain in full force and effect.
9.3 Changes. We may modify these Terms at any time. If we do, we will post the changes on this page. Your continued use of the Services constitutes acceptance of the modified Terms.
